Welcome to Joyday Studio, a locally owned Houston photography studio specializing in school portraits for preschools and elementary schools throughout Greater Houston. Joyday Studio is a division of Musee Studios, LLC, a Texas limited liability company.

These Terms & Conditions govern the use of our website, photography services, online galleries, and portrait ordering platform. By accessing or using our website, purchasing photography products, or otherwise expressly agreeing to these Terms & Conditions, you agree to be bound by the provisions outlined below.

These Terms & Conditions apply to the fullest extent permitted by applicable Texas and federal law. Nothing in this agreement limits any rights or protections that cannot legally be waived.

1. Photography Services

Joyday Studio provides professional school photography services to participating preschools and elementary schools. Photography sessions are coordinated directly with each school, and session dates, schedules, and photography arrangements are established in advance. While we make reasonable efforts to photograph every participating student, we cannot guarantee that every child will be photographed. Student absences, illness, refusal to participate, behavioral concerns, scheduling conflicts, school restrictions, or other circumstances beyond our reasonable control may prevent a photography session from taking place.

Joyday Studio reserves the right to decline or discontinue an individual photography session when a child's participation presents a safety concern, causes significant disruption, or cannot reasonably be completed under the circumstances. We do not guarantee a specific number of photographs, poses, expressions, backgrounds, or final images for any individual student. Participation in photography sessions is subject to applicable school policies, parental consent requirements, and any separate written agreements between Joyday Studio and the participating school.

2. School Picture Day and School Responsibilities

Joyday Studio works with participating schools to coordinate an organized and efficient picture day experience. The school is responsible for providing accurate student information, communicating relevant photography arrangements to families, coordinating student participation, and identifying any applicable photography restrictions or parental consent requirements.

Unless otherwise agreed in writing, the school remains responsible for the supervision, care, and management of its students throughout picture day. Joyday Studio photographers are responsible for conducting photography sessions and are not acting as substitute teachers, childcare providers, or school personnel.

Joyday Studio may reasonably rely on information and instructions provided by authorized school representatives when coordinating photography sessions and student participation. Any additional obligations concerning school supervision, student information, parental permissions, scheduling, or photography arrangements shall be governed by the separate written agreement between Joyday Studio and the participating school.

3. Scheduling, Cancellations, and Rescheduling

Joyday Studio reserves the right to reschedule, postpone, or modify photography sessions when reasonably necessary due to severe weather, natural disasters, emergencies, illness, equipment failure, school closures, unsafe conditions, or other circumstances beyond our reasonable control. When possible, we will coordinate alternative arrangements with the participating school.

Joyday Studio does not guarantee individual makeup sessions for students who are absent, unable to participate, or unavailable during their scheduled photography session. Any school-specific cancellation fees, rescheduling arrangements, or additional photography dates shall be governed by the applicable school photography agreement.

4. Photography Style and Artistic Discretion

Joyday Studio maintains creative and professional discretion over all photography services, including lighting, posing, composition, backgrounds, image selection, editing, and final presentation. While we strive to create portraits that families will love, photography is inherently subjective, and individual preferences regarding expressions, poses, appearance, or artistic style do not automatically constitute a defect or failure to provide services.

The number and variety of photographs available for purchase may vary depending on the child's participation, comfort level, cooperation, and the circumstances of the session. Joyday Studio does not guarantee that every student will produce a photograph suitable for purchase.

5. Online Galleries and Authorized Access

Student photographs are delivered through private online galleries. Gallery access is intended only for authorized parents, legal guardians, and other individuals approved by the participating school. Joyday Studio works with participating schools to establish appropriate gallery access procedures. Families are responsible for maintaining the confidentiality of their gallery links, passwords, access codes, and other identifying information.

Users may not attempt to access, download, distribute, or otherwise obtain photographs of students for whom they have not been granted authorization. If you receive access to photographs that do not belong to your family, you agree to refrain from downloading, sharing, or distributing those images and to notify Joyday Studio promptly. Joyday Studio may suspend or revoke gallery access when reasonably necessary to protect student privacy, investigate unauthorized activity, or address violations of these Terms & Conditions.

6. Portrait Orders and Payments

All portrait orders are subject to the prices, product descriptions, and availability displayed at the time of purchase. Applicable sales tax, shipping fees, and other charges will be disclosed during checkout. Payment must be completed before an order is processed.

Customers are responsible for reviewing their selected photographs, product specifications, quantities, personalization details, and delivery information before submitting an order. Once an order has entered production, modifications or cancellations may no longer be possible.

Joyday Studio reserves the right to correct obvious pricing errors, product description errors, or technical inaccuracies. If an error affects an order that has already been placed, we will notify the customer and provide an appropriate resolution, including a refund when required.

7. Refunds, Returns, and Product Issues

Because portrait prints and photography products are personalized and made to order, all sales are generally final once production has begun. Digital image purchases are nonrefundable once the purchased files have been delivered or made available for download, except as required by applicable law.

Customers who receive incorrect, damaged, or defective products should contact Joyday Studio within 14 days of delivery and provide their order information and a description of the issue. Joyday Studio will review the concern and determine an appropriate resolution, which may include a replacement, reprint, correction, or refund.

Minor variations in color, brightness, cropping, or appearance may occur between digital displays and printed products due to differences in monitors, printing processes, and materials. Such variations do not automatically constitute a product defect. Nothing in this section limits any refund, replacement, or other consumer rights that cannot legally be waived.

8. Digital Images and Personal Usage Rights

Customers who purchase digital photographs receive a nonexclusive, nontransferable license to download, save, print, and share those images for personal, noncommercial purposes. Digital photographs may not be sold, licensed, commercially reproduced, or used for advertising or promotional purposes without prior written permission from Joyday Studio.

Purchasing digital photographs does not transfer copyright ownership or grant unrestricted commercial usage rights. Customers are responsible for maintaining their own backup copies of purchased digital photographs. Joyday Studio is not obligated to provide replacement files after the applicable gallery expiration and image retention periods have ended.

9. Copyright and Intellectual Property

Unless otherwise agreed in writing, all photographs, images, designs, website content, logos, and other original creative materials produced by Joyday Studio remain the intellectual property of Musee Studios, LLC, doing business as Joyday Studio. No ownership rights are transferred through the purchase of photography products or services.

Unauthorized reproduction, commercial distribution, resale, or modification of Joyday Studio's copyrighted materials is prohibited except as permitted by applicable law or an express written license.

Schools wishing to use student photographs for promotional materials, websites, social media, or other public purposes are responsible for obtaining any required parental permissions and appropriate image usage rights. Joyday Studio will not use a student's photograph for advertising, social media, promotional materials, or other public purposes without written permission from the student's parent or legal guardian.

10. Student Privacy and Personal Information

Joyday Studio takes the privacy and security of student photographs and personal information seriously. We collect and use personal information only as reasonably necessary to provide photography services, coordinate with participating schools, communicate with families, deliver online galleries, and fulfill portrait orders.

We do not sell personal information or share it with third parties for their independent marketing purposes. Information may be disclosed to service providers when reasonably necessary to operate our business, including photography gallery platforms, payment processors, professional printing laboratories, and shipping providers.

Joyday Studio uses reasonable administrative, technical, and organizational measures to protect student photographs and personal information. However, no electronic storage system, website, or online transmission method can be guaranteed to be completely secure. 11. Image Retention and Gallery Expiration

Joyday Studio retains student photographs for a maximum of six months following the delivery of school pictures. After this period, student photographs are permanently deleted from our computers and online galleries in accordance with our published Privacy Policy. We do not maintain a permanent archive of student photographs.

Families are responsible for purchasing, downloading, and saving their desired photographs before the applicable gallery expiration date. Gallery expiration dates may occur before the end of the six-month image retention period and will be communicated when galleries are delivered.

Once photographs have been permanently deleted, Joyday Studio cannot guarantee their recovery, reproduction, or availability for future purchase. To the extent permitted by applicable law, Joyday Studio shall not be responsible for a customer's failure to purchase, download, or preserve photographs before the applicable expiration date.

12. Website and Third-Party Services

Joyday Studio may use third-party platforms to provide website hosting, online galleries, payment processing, printing, shipping, and other services. These platforms may operate under their own terms, privacy policies, and technical requirements.

Although we make reasonable efforts to select reliable service providers, Joyday Studio cannot guarantee uninterrupted access to third-party systems or prevent every technical error, service interruption, or delivery delay.

To the fullest extent permitted by applicable law, Joyday Studio shall not be liable for indirect or consequential losses resulting from third-party service interruptions, technical failures, or circumstances beyond our reasonable control. Nothing in this section excludes liability for Joyday Studio's own conduct where such liability cannot legally be excluded.

13. Assumption of Risk and Student Safety

Joyday Studio strives to provide a safe, comfortable, and age-appropriate photography experience for all participating students. Photography sessions may involve ordinary activities such as standing, sitting, posing, walking, and interacting with photography equipment or props.

Participating adults acknowledge that ordinary activities may involve certain foreseeable risks and agree to follow reasonable safety instructions provided by Joyday Studio personnel. Schools remain responsible for supervising their students during picture day unless otherwise agreed in writing.

Joyday Studio reserves the right to discontinue any photography activity that presents an unreasonable safety concern. Nothing in these Terms & Conditions constitutes a waiver of a minor's legal rights or claims, and no provision shall exclude liability that cannot lawfully be waived under applicable Texas law. Any separate parental consent or liability release shall be governed by its own terms and applicable law.

14. Limitation of Liability

To the fullest extent permitted by applicable Texas law, Musee Studios, LLC, doing business as Joyday Studio, and its owners, members, employees, photographers, contractors, representatives, and agents shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to the use of our website, photography services, online galleries, portrait orders, or photography products.

Joyday Studio shall not be responsible for losses arising from circumstances beyond our reasonable control, including natural disasters, school closures, third-party service interruptions, shipping delays, or events that prevent the completion of scheduled photography services.

To the fullest extent permitted by applicable law, Joyday Studio's aggregate liability for claims arising from an individual portrait purchase shall not exceed the amount paid by the customer for that purchase. Claims arising from photography services provided under a separate school photography agreement shall be subject to the liability provisions of that agreement, to the extent enforceable.

Nothing in these Terms & Conditions excludes or limits liability for personal injury, negligence, gross negligence, intentional misconduct, violations of applicable law, or other claims to the extent such liability cannot lawfully be excluded or limited.

15. Indemnification

To the fullest extent permitted by applicable law, website users and customers agree to indemnify and hold harmless Musee Studios, LLC, doing business as Joyday Studio, and its owners, members, employees, photographers, contractors, and representatives against third-party claims, damages, liabilities, and reasonable legal expenses arising from their unauthorized use or distribution of student photographs, infringement of another person's intellectual property or privacy rights, intentional misconduct, or material violation of these Terms & Conditions.

This provision does not require customers to indemnify Joyday Studio for claims arising from Joyday Studio's own negligence, misconduct, or violation of applicable law. Any indemnification obligations involving participating schools shall be governed by the applicable school photography agreement.

16. Website Accessibility

Joyday Studio is committed to providing an accessible website and photography experience for individuals of all abilities. We strive to make our website, online galleries, and ordering services accessible to individuals who use assistive technologies or require reasonable accommodations.

17. Governing Law and Jurisdiction

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the State of Texas, without regard to its conflict-of-law principles. To the extent permitted by applicable law, any legal action arising from or relating to these Terms & Conditions shall be brought in the appropriate state or federal courts located in Harris County, Texas.

Nothing in this provision shall deprive consumers of any legal rights or protections that cannot lawfully be waived.

18. Severability

If any provision of these Terms & Conditions is determined to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permitted by applicable law, or severed if necessary. The remaining provisions shall continue in full force and effect to the extent permitted by law.

19. Entire Agreement

These Terms & Conditions, together with our Privacy Policy and any applicable written purchase agreements, constitute the agreement between Joyday Studio and the website user or customer regarding the matters addressed herein.

Any separate written agreement between Joyday Studio and a participating school shall govern the photography services provided to that school. In the event of a conflict between these Terms & Conditions and an applicable school photography agreement, the school photography agreement shall control with respect to the matters covered by that agreement.

20. Changes to These Terms

Joyday Studio reserves the right to update these Terms & Conditions periodically to reflect changes in our services, business practices, or applicable legal requirements. Updated terms will be posted on this page with a revised effective date.

Changes will not retroactively alter the terms of completed purchases unless permitted by applicable law.
